The Spanish Association of Publishers Guilds (FGEE) press release: The Spanish book sector rejects the European Commission's guidance. July 8, 2021

The book sector rejects the European Commission's guide for the Agreement in the collaboration of copyrights.

The Federation of Publishers Guilds in Spain (FGEE), the Association of Writers in Spain (ACE), VisualEntidadde Gestión de Artistas Plásticos (VEGAP), and CEDRO, want to express their rejection of the drafting of the guide prepared by the European Commission for the negotiation of Article 17 of Edict 2019/790 on copyrights in the digital market.

This article establishes for the first time the legal responsibility of technological platforms when there is traffic of digital content. In the opinion of these organizations, despite the fact that the European Commission recognizes that this document is not binding due to the the way it has been drafted, with a pseudo-legislative character, it seems that they want to give it a greater importance than what has been the norm, exceeding their position.

The document prepared by the Commission is full of indeterminate legal concepts, linked to each other, which makes their implementation impossible, creating great legal uncertainty.
